Thank you for the info and references. It does seem a bit murkey. In all likelihood, defendant probably won't complain unless he has a retained attorney, but given that 'justice' is the job, I need to be as sure as I can that what I file is right (or provide clear reasoning for not filing - don't want to alienate our officers when they are acting as instructed).
