I work in a county that has a border patrol checkpoint. Quite frequently the checkpoint will request a deputy to deal with a suspicious vehicle that they suspect is transporting/smuggling/scouting for illegal alien and/or narcotics. Most of the time the driver is going to be DWLI/No DL, No insurance, etc so impounding the vehicle is a given. Occasionally the customer will have everything in order but will not know who the vehicle belongs to or how to get in contact with the owner. I have impounded the vehicle for safekeeping because the vehicle could have recently been stolen but not discovered by the owner. Is there any type of case law to suport this action, and/or is it an action that could be defended if the dept is ever sued for taking that type of action?
