Have a very strange case in a municipal court, the city it seems on purpose sent the wrong address and contact info for the appeal to the higher court, in turn the Appeal was denied for untimely file of brief. Client had me do a Petition to Recall Mandate and we have a pretty strong case to get it recalled to re file the Appeal. Problem is that the Court Clerk and Court refuse to file and forward the petition. There is some confusion on whether it should be filed in the criminal court it was appealed to or go straight to District Court? Any suggestions would be great!! Also a form to go by to get the Clerk and Court on the Writ...
