Has anybody out there used 37.09 in a DWI case where a drunk driver flees the scene of a crash? on a theory that, knowing DWI had been committed, the defendant concealed all of the evidence of intoxication with intent to impair its availability as evidence in the subsequent investigation?

it may amount only to attempted tampering. but if anybody's done this, i'd love to know how it went.
