I was just wondering if anyone out there includes in a Motion for Limine that the defense must make motions for mistrial (especially on grounds such as prosecutorial misconduct) OUTSIDE the presence of the jury. We've had some drama in the courtroom regarding this lately and I'm scared it's going to start costing the State cases when all of the defense attorneys catch on.
