I have a case where attorney's wife served on the grand jury that indicted defendant. Defendant hires the attorney and wants to represent him. We made an oral motion to disqualify the attorney from the representation to the bench. He responded that his wife is necessary in his work as his office secretary and legal assistant. He stated his client has a right to choose his representation. I can't find any case law on point. Any suggestions? | ||
