Can anyone explain to me why a public park isn't always a drug free zone?

I would guess that a public park is not specifically listed in H&S 481.134 as a drug-free zone. I just did an appeal on whether the "playground" fit within the definition as specificied in 481.134. The complaint was it did not have 3 or more separate apparatus intended for the recreation of children.

I think the only way a public park would fall within 481.134 is if it had either a playground, youth center, video arcade or public swimming pool within its confines.
