Can a crime victim use a probation restitution order to place liens on a defendant's real estate just as he could if he had a civil judgment against the defendant? What about a court finding of restitution owed in cases where the defendant is sentenced to TDC? I'll post this same question on the civil board as well. Any help is appreciated. | ||

42.22 of the Code of Criminal Procedure sets out the procedure for the victim and the State to file liens based on criminal restitution There may be other statutes as well but I believe this is what you may be looking for. | |||

42.037 (m) answers your question more fully the answer is yes it can be enforced as in any civil action | |||
