[ed. - this post is from Sam Oatman, 33rd DA. Please direct all responses to him at L33rdda@moment.net or 325/247-5755.] Problem Many offenders in "hit and run" accidents leave the scene because of having consumed drugs or alcohol or they knew they were intoxicated. Later, they turn themselves in after any evidence of alcohol or intoxication is no longer accessible resulting in lesser consequences. Hopefully, some legislation could be an incentive to stay at the scene. Legislative Suggestion Place the range of punishment for failure to stop and render aid (or assistance under the TPWL Code) a degree higher or the same as that for intoxication manslaughter, intoxication assault or felony Driving While Intoxicated. Any responses or suggestions would be appreciated. - Sam Oatman | ||
