Can anyone recommend resources and caselaw to show that inhalants cause impairment for driving? In this hypo, the aerosol air cleaner "Ultra Duster." The DPS lab found 1,1-Difluoroethane in the blood. | ||

We have successfully prosecuted many of these cases. Only one had a "positive" blood test, as most of the intoxicating chemicals leave the blood so quickly. Your lab folks should be able to testify to the effects on the human body. Also - If your case is like most huffing cases, you should have a witness or two, plus your first responding officer who can testify to the defendant's mental/physical faculties at the time. JW- Texas Poison Control centers have community education specialists that can help out. From what I've been recently told, those who handle the 800 number are toxicologists. | |||
