Has anyone had to deal with this case? The defense attorney mentioned it to me and I found it. It says the breath test should not be admitted if the corresponding retrograde extrapolation is not admitted because the test was done 80 minutes after driving. Published opinion out of San Antonio. No. 04-02-00314-CR

FYI the Beard case is dead, literally, and the opinion is being withdrawn.

I saw the header for this topic and thought I was going to find more dirt on Martha Stewart and some kinda federal drunk driving charge they piled on to her.
