Vehicle stopped for not having headlights on (3AM). During stop MJ and a firearm are discovered. Firearm is auto and has no ammunition and no magazine. Firearm was reported stolen two years prior. Do I have a provable theft of firearm case? | ||

From a former Cherokee Co. prosecutor (1980): You'd have to prove he stole it or knew it was stolen. The gun could have changed hands many times in two years. I once had a gun stolen from my house by some kids the teenaged daughter let in. It was found two years later - in the possession of a Kansas policeman who had bought it at a police auction. I told him to just keep it since he had put more money into it than I had. | |||
