A friend just came back from the Municipal Attys / Prosecutors school with tidings about this case (Tx Crim App 6/4/03) I haven't had time to study it, but apparently the presenter claimed that it will cause problems anytime the State wants to admit a test (HGN, radar, UA) without an expert by relying on the acceptance of the underlying theory. Supposedly, some communities have conducted a "study" that served to educate their trial court judges adequately to allow the evidence in without the expert. On the first two readings, I'm not seeing anything about the "study", but am not real happy with the case. What do y'all think? [This message was edited by Lisa Peterson on 06-20-03 at .]
