I have a stalking case in which the victim is the mother of a police officer. In addition to the phone calls, threats, following, etc that the defendant has made to the victim, the defendant was stopped in the victim's parking lot prowling around her car. The defendant was also arrested for carrying a pistol in her car around the time of the stalking. Since the victim's son is a cop, the arresting officers fill her in on each case. Is the victim's knowledge of these acts admissible because it goes to her state of mind of fear? It is hearsay as to the victim but it heightened her fear. | ||
