I have a case where the defendant was found not competent to stand trial/not likely to be restored to competency. However, he was also found not to be a danger to others and no longer requiring in-patient hospitalization. This guy has repeatedly sexually assaulted children and is a diagnosed pedophile and I need to keep him locked up. About the only thing I can find that is somewhat helpful is the Texas Civil Commitment of Sexually Violent Predators Act--and it looks like under this statute, he is treated on an outpatient basis. Any suggestions on what else I can do or if this is my only avenue, how to go about it? Does anyone have a sample petition I can look at?
