Can you get a warrant for a material witness warrant for a person now living out of county and if so how? We have a witness and her daughter, who is also a witness, that are dodging service and we need them for trial the first week of May. They were living in our county in January but we have word they are now living in another county, probably with the defendant. | ||

Article 24.14 probably covers you when the witness lives in the county. Article 24.16 is the out of county subpoena statute, and Article 24.20 allows you to request bond for some witnesses and would apply to 24.16. Hope this helps. Read these carefully. To my knowledge, there is no such thing in Texas law as a material witness warrant. | |||
