Scenario:
Fellow inmates assist county jail inmate in his escape by lifting sally-port door so that he can slip underneath. Escapee is in custody for UUMV.

Can PC 38.07 be applied to the other inmates in this situation? The way I read it, the answer is NO. I've searched for another provision under which to charge these "darlings" for their actions, but have not found anything. Surely there is a way to charge them! A charge under the penal code is going to be more "just" than what most Sheriffs want to do in these circumstances!

Anyone else have experience with this?

Sec. 7.02(a)(2) in combination with 38.06 would appear to fit nicely to me.
