I have a case where the person who was injured in an accident was the passenger in a one vehicle accident. The arresting agency filed on the driver for failing to stop when involved in an accident involving personal injury or death. Has anyone charged a driver this way before? The car eventually stopped a few blocks away and the driver and passenger got out and went into their house where the officer found them.
In case you're wondering, the driver is a DWI repeat offender and was likely drunk that day, though we are still awaiting blood results. So we don't care for her very much. Thanks for the help.
