I have a 64.04 hearing today and the defense attorney wants to call the forensic scientist that did the DNA testing to testify. The way I read the statute is that the judge looks at the DNA results and issues findings. I believe that testimony or evidence is not proper for this hearing. Has anybody had a situation like this? Any suggestions on how to handle it? | ||
