Can the statute ever run on this crime? It seems to me that every case of failure to report since the effective date of the statute is still viable. Today a detective came to the office to file a case of agg sex assault-child. The defendant fully penetrated this 11 year old and caused some significant tearing of the hymen. Mom gave a statement to the effect that the child had told her the def was abusing her FIVE years ago. What do you think? Can mom be charged with failing to report five years ago?
