We have a defendant who was placed on deferred adjudication in 1999 for an indecency with a child that occured in 1997 who's now asking for an early termination. I know section 20 of 42.12 says no early term but is that regardless of date of offense? | ||

If a defendant is placed on deferred adjudication for certain sex offenses after 8/31/99, no early termination. If the sex offense was committed after 8/31/95 but before 9/1/99, early termination is not available until 2/3rd of the term is successfully completed. Before 9/1/95, all sex offenders were eligible for early termination. See Acts 1999, 76th Leg., ch. 1415. | |||
