 Is anyone familiar with any case law concerning the number of jurors to be used in a District Court case where the court is hearing both a felony and a misdemeanor charge (official oppression)?  I would assume you would have to use a 12 person jury since the Texas Constitution requires that number for non-misdemeanor cases, but is there any specific case out there that confirms the District Court is to use 12 jurors in such circumstances? | ||
