Maybe its just my luck but almost every murder case I have I am getting a message from DPS indicating that the testing will likely deplete the samples and requesting my permission to continue with testing.

In the latest case, I notified the defense of the potential depletion and now they are "objecting".

The only case I found that talked about depletion was Fain out of Ft. Worth. The opinion indicated that the State filed a motion to allow depletion and the Judge signed it. I'm still researching.

Anyone else having this issue and if so whats your office procedure. Really whats the option ?? Don't test ??
