Here's the facts: Defendant has a warrant out for Aggravated Assault with a Deadly Weapon. Defendant is found driving around with a loaded Smith & Wesson .40 cal pistol, a loaded SAIGA brand AK-47, a billy club, lots of ammo, a black hooded sweat jacket, a black beanie cap, a pair of sunglasses, a black ball cap, and two portions of women's panty hose. None of which was in plain view. The defendant admitted he knew he had a felony warrant outstanding. We have charged this defendant with UCW and the criminal activity as "the defendant knew he was a fugitive from justice." However, we are having trouble finding anything that says that this counts as criminal activity for UCW. Any input? Or any thoughts on a different charge we could use? Thanks in advance! | ||
