Brand new Valley prosecutor here, trying to feel my way around. I always wanted to be an ADA, so I'm excited to be here. My boss has a question, and I'm drawing a blank. This may well be obvious and I'm just missing it. Question: Crime scene evidence, evidence is collected at a crime scene and held by a PD, for example, there is a shooting and it occurs in the vehicle of a 3rd party who is not involved in the offense, 3rd party wants their vehicle back. What is the legal basis for the PD to hold the 3rd party's property as evidence of a crime? | ||
