Tarrant County is going to appeal a trial court's ruling preventing prosecutors from using Iowa DWI misdeameanor convictions to enhance the defendant's aggravated assault charge. The State wants the first degree punishment range available, and the priors carried a possible prison term. The defendant who is on trial for seriously injuring a child while DWI had previously injured five people in a similar wreck.
He also faces Intoxs m/s and felony DWI charges.
