Has anyone put into evidence these crash data retrieval systems information? Basically it is a black box for cars. Just wondering who you called as witnesses when offering these results.

A couple of great experts are availible. Tim Lovitt in Fort Worth 817 268-7797. Andy Holcomb in Lubbock 806 775-1100. Tim is now in a private company called Crash Dynamics and Andy is in the Lubbock DA's office as an investigator. I think they are both excellent.

We've used Tim Lovett here in Parker County on a number of cases, including to pull the black boxes and retrieve the information to use in a crash reconstruction.

Robert, did you call anyone from the black box company to come authenticate the records or the science behind it ???

The short answer is no. Our cases are still pending.

We retained Tim and his firm as expert witnesses in accident reconstruction. Their reconstructions are done in compliance with the standards used by persons in their field (including the use of black box information). There is no need to have every piece of evidence relied upon by an expert put into admissible form. Their opinion can be based on what would otherwise be inadmissible evidence. Tim is well versed in the science behind black boxes, the measurements taken, the frequency of the measurements taken, and all of the various information recorded. He is similarly familiar with the software used to remove that information from the black box and turn it into useful information.

He should easily cause as an expert it witness reconstruction. On the negative side--its costly to have these things done. Expect to pay $4000-$6000 just for the complete workup with testimony and trial prep additional.

Jeff Strange in Fort Bend County had a full blown 705 hearing on the matter and brought in Rusty Haight (the crash guy from San Diego on the Discovery Channel) as the state's expert. Jeff has transcripts. Tim would be an excellent choice as well. David Pearson with the HCSO is also a great reconstructionist and has assisted other agencies on these issues. Let me know if you need his number.
