The Supreme Court agreed Monday to decide a frequently recurring question involving immigrants: whether they must be told by their lawyers that they face deportation if they plead guilty to serious crimes. Details. [Texas has long required an admonishment as part of any felony guilty plea. But, Texas has also long held that the admonition is not constitutionally required, only a statutory mandate. If the SCOTUS says it is constitutionally required, that will open the door to 1) lots of postconviction writs and 2) arguments seeking to expand such constitutional requirements to lots of other collateral consequences to conviction (e.g., sex offender registration, loss of gun and voting rights, etc.). Strange for the SCOTUS to take the case given the fairly consistent rulings against recognition of any constitutional requirement.] | ||
