One of our law enforcement agencies is investigating a murder which probably occurred at a residence belonging to the victim. Two defendants have been arrested but not yet indicted for the murder. One defendant is a relative who may have some joint possessory interest in the residence. Both defendants have attorneys. The investigation of the residence is complete. One defendant's attorney has requested to view the residence "prior to it being cleaned up." Should we grant the request prior to releasing the scene? Should we notify the attorney who has not made a viewing request? What limits should reasonably be placed on a viewing such as photographs/video only, no seizures of any kind, etc.? Any other ideas or concerns??? | ||
