Can an infant be a listed victim of an agg. robbery? Facts show that def. threatened to kill infant (held gun to head) if parent didn't turn over property. I have case law that says a victim doesn't have testify to show threaten/place in fear. What do you think?
he threatened another (the infant) with death or SBI and used/exhibited a deadly weapon, so I would say yes to Agg. Robb. with the infant being the person threatened.
The parents would hopefully be willing to testify to that.

Yes, the parents are cooperative. The defense is saying that an infant can't feel fear of imminent bodily injury/death. I was thinking along the lines you were, that the threat is the way to go instead of the place in fear.... . Thanks.
