That's all basically correct. Think of this offense as ID Theft + harm/defraud by online means. Simply using an image of someone in a way they don't appreciate is not a crime under 33.07. That is one reason why the Manti Te'o-Lennay Kekua hoax is probably not a crime in Texas (for one example). |

| I was more focussed on the false persona-- aspect of 33,07 is subsection a--was there any message with the photo or did it correlate with a message already on the page--not sure if this fits or not. |
