Still in the middle of a punishment phase of my capital case. The defense is apparently planning on calling the above psychologist in rebuttal to MY rebuttal case. I WAS NOT furnished with notice of this expert pursuant to my Art. 39.14 request for expert discovery. He is a psychology professor at SMU and was formerly at Sam Houston State. Anyone dealt with him? Also, is anyone aware of any authority suggesting the trial court can exclude a defense expert for failure to furnish the notice required under 39.14? Thanks.
