Man takes an extension cord and pugs in to the outdoor power outlet off of his neighbor's trailer. What class misdemeanor do you charge? Given Santana v. State, 59 S.W.3d 187, I'd say a class A. Does it matter that the defendant didn't tamper with the meter on the neighbor's home? What if the flux in the Electric bill makes it difficult to nail down a pecuniary loss? | ||

I have not read Santana, but using PC Sec. 31.08 (c) makes it a Class A misdemeanor theft. | |||
