We have a potential defendant that provided a juvenile access to unloaded firearms. The firearms were stored with ammunition, and the juvenile shot another person with the firearm, resulting in serious bodily injury. Facially, Penal Code 46.13 requires the firearm be stored "readily dischargeable". If so, no case against defendant. I would like to argue access to a firearm and ammunition, coupled with subsequent loading of the weapon by the juvenile meets the threshold requirement of "readily dischargeable". Has anyone seen this before? Any help? | ||
