I have a case with multiple co-defendants; the first of four trials is set to begin in two weeks. I have a couple of pieces of evidence that I'll need for each trial, i.e., particular items gathered at the crime scene and later tested at the lab for DNA, trace, etc. How do I handle this, procedurally? File a Motion to Substitute Evidence and get an order form the Court, asking permission to substitute a picture in place of the item? Then what - send back to LE to keep in evidence until the next trial? For anyone who has done this, I seek guidance. | ||
