Is anyone keeping track of the number of times the Texas Defender Service (or capital defense counsel in general) files last minute capital writs and then claims that a stay should be granted because there isn't enough time to fully consider their claims? Talk about killing your parents and then begging for mercy because you're an orphan. The rules need to be changed to insist on an orderly presentation of habeas claims. One of those arguments won a stay this week. http://www.chron.com/cs/CDA/ssistory.mpl/metropolitan/3100050 http://www.ca5.uscourts.gov/opinions%5Cunpub%5C05/05-70012.0.wpd.pdf | ||
