Just wondering if anyone has ever prepared a “Request for Renewal of Orders for Inpatient Commitment” pursuant to 46C.261 CCP?

Brief Facts: Defendant was found NOT guilty by reason of insanity and was committed to state hospital. Now, his commitment is about to expire and I have to prepare a “Request for Renewal” so that the judge can re-evaluate if he needs to stay.

Any help would be greatly appreciated! 

Call me at 713 274-6701, or email me at floyd.jennings@pdo.hctx.net

I have the forms. Note that the hearing is before the court unless the acquittee/defendant requests a jury trial (see 46C.255). 46C.253 requires the hearing be conducted pursuant to the rules of the H&S Code, so you can talk to your counterparts on the civil side who do extended commitments. The important part is that you must take testimony (which may be telephonic and very brief) even if you stipulate to the contents of the single medical certificate that is required under 261.
