Defendant commits UUMV in county A, drives vehicle to county B, stopping along the way and getting out of the vehicle, then resuming his trip to county B. Can defendant be prosecuted separately in each county for UUMV? Or is there a jeopardy issue? Defendant was initially arrested in county B, and is indicted in county B. Has already pled in county A...

Art 13.23 of the CCP says UUMV can be prosecuted in any county where the unauthorized use of the vehicle occurred, or in the county in which the vehicle was originally reported stolen. So you can do County A, or County B, but you can’t do both. Indictment in County B should be dismissed now that the case has been disposed of in County A.
