Does anyone have a charge for a misapplication of trust funds under section 162.031 Texas Property Code?

I've looked at misapplication under the penal code and that charge does not fit the language of misapplication under the property code.

There's a case regarding this issue which was overturned (Murphey v. State).

I'd hate to re-invent the wheel if someone has one that they have used and worked. Thanks.
