A magistrate protective order was entered by a JP after an aggravated assault with a deadly weapon. A defense attorney properly transferred it to District Court but now has filed a Motion to Vacate. I believe that this is incorrect and it is my understanding that a magistrate protective order can only be modified. A Motion to Vacate would have been proper if there was an EPO. I plan to file a response but I am looking for some guidance. I greatly appreciate any help! Thoughts?
