If I didnt dismiss I would make damn sure the judge was aware of the case law and my arguments why the higher court is wrong. The judge will not thank you if he unkowningly makes new law or the defendant gets a new trial for inadequate counsel. I also agree with the above post that someday that officer might be involved in a must win case and deserves to have as much knowledge/warnings as we can give.
