Here is an interesting opinion on the subject of when a judge can dismiss a case over the objection of a prosecutor: State v. White. There have been several threads discussing when a judge must sign a dismissal. This looks at it from the other side. There was some controversy attached to this dismissal, as the judge who decided the case didn't issue the decision until just before leaving the bench for retirement. Guess someone else will now have to hear the trial. | ||
