I looked in the Extradition book, but not sure I see clear answer to this question. Prisoner signs waiver of extradition, other state is notified. Its been 10 days since then. How long can jail hold before they have to cut him loose and tell the other state to try again? | ||

I think it's 60 days; see CCP Art. 51.13, Sec. 17. | |||

Facts: 1. D arrested on parole violation from another state. 2. Has refused to waive extradition. 3. Contact has been made with the other state and they are starting the paperwork at their end, Texas Governor's Counsel has been given a "heads up." 4. D is being held no bond at this time. 5. D has now filed a writ seeking (I think) release or a bond. 6. Is D entitled to a bond hearing? Please reply to my email. There are lurkers. | |||
