The juvenile was placed on probation for 5 years with a ten year exposure on an agg sex asslt. At age 18 he was transferred to felony court for continued supervision. The clerk's record recites that he is on DFAJ in District Court. He is up for rvocation. Is he on DFAJ in felony court? Is this a straight probation? Sould I file a motion to revoke or adjudicate? (or file a motion asking for adjudication or in the alternative revocation)? | ||

A person placed on a formal juvenile probation that is transferred to an adult district court is on regular adult probation. He was found true of the offense as a juvenile; this cannot be undone. The purpose of this law is to be able to revoke their probation and to send them to straight to TDCJ. It is impossible for a determinate sentence probation to be a juvenile differed probation. It should not follow that when the case is transferred to the adult court, the juvenile finding of true is somehow gone. | |||
