I wonder if Zofia Smardz (see issues in prosecution) would approve of the definition which has been called "probably the most satisfactory definition ever given to the words 'beyond reasonable doubt' in any case known to criminal jurisprudence." Namely, "that certainty which convinces and directs the understanding, and satisfies the reason and judgment, of those who are bound to act conscientiously upon it." She makes an excellent point in her article in the Washington Post. Thanks for posting it! | ||
