Defense attorneys are all the time getting grieved on for not cross-examining on this or that. The story on the Issue in Prosecution page points out the difficulty in challenging a story. Sometimes the victim gets more believeable: "He was my bishop, the only guy I put my faith into," Buchanan said. "I was a virgin and the same guy that baptized me raped me." While a prosecutor in Harris County, I watched a defense attorney (very old, half deaf, but wise) argue openly with his client about whether the defendant should testify. Everyone, including the jury, watched the lawyer eventually throw up his hands and point the defendant to the witness stand. Upon the completion of his performance, the defense attorney watched his client walk despondently back to his chair, and said loud enough for everyone to hear, "Well, are you happy now?" Quick guilty verdict. | ||
