I am seeking a protective order in a case where a woman was stabbed in the head while she was pregnant and, at the same time, was threatened to have her baby cut out of her stomach. The baby is now born, and the Respondent is the baby's father and a former member of the Applicant's household. I am seeking the protective order to keep him away from the baby as well as the mother. The penal code includes "an unborn child at every stage of gestation from fertilization until birth" in the definition of a person, but the family code is not this specific in its definition. Does anybody have any ideas that will allow the now-born child to be a candidate for a protective order?
