Can you file Class B DWLI and Class C No DL on a person for the same incident? | ||

I would not recommend it. With a DWLI you have to prove the defendant operated a motor vehicle on a public roadway at a time when his license was suspended or invalid. With a No DL on Person you have to prove the defendant operated a motor vehicle on a public road way at a time when he did not have his DL on his person. This comes uncomfortably close to a Double Jeopardy claim. | |||
