Mother takes her 14 year old daughter to the apt. of a pair of brothers for the purpose of letting the 16 yr. old boy have sexual intercourse with her daughter.

Assuming we can prove that the mother's purpose in taking her daughter to the apt. was for her to have sex with the lad, do you think we can make a case of sexual assault of a child against her?

If the daughter was 14 and the boy was within 3 years of her age, there is an absolute affirmative defense under PC Sec. 22.011(e) if it was consensual.
