A defense attorney hired a records service outfit to send depositions on written questions to obtain medical records in a pending criminal case. I don't have a problem with the release of the records because they are records of the defendant. However, I don't think the rules of civil procedure have any application in criminal cases. I don't know that the rules of criminal procedure allow for it. Has anyone addressed this? I never have. As always, thank you for your help.
